Section 13.24.010 Application for reimbursement.
Prior to the adoption of 13.24.010 (Ord. 2127) on 01/20/2003, Section 13.24.010 read as follows.
Any owner or owners of real property located within the facility
planning area of the city of
Columbia, Illinois, as the facility planning area boundaries of the city now exist or shall be
hereafter amended, or in the event of the abolition of facility planning areas by the Illinois
Environmental Protection Agency ("IEPA"), then as said boundaries existed at the time of the
abolition of the same, (the "facility planning area" or the "EPA" or the "Columbia
FPA") who
proposes or propose to construct sanitary sewer disposal and/or potable water transmission
facilities which will serve other properties in the Columbia FPA (hereinafter referred to in this
chapter as the "sponsor") may make application to the city council for the recoupment by said
sponsor of a proportionate share of the total cost of construction of the sanitary sewer and/or
water facilities from benefitted property owners who directly or indirectly tap-in to or use the
same, in accordance with the provisions and the requirements of this chapter. Said application
shall be accompanied by: (i) complete improvement plans and specifications for said sewer
and/or water facilities, (ii) at least three sealed competitive bids or a copy of the proposed
construction contract or a detailed and itemized cost estimate if the sponsor intends to serve as
the contractor who will construct and install the facilities. The application and said bids, contract
or cost estimate shall be filed with the city clerk. The city clerk shall deliver copies thereof to
the
city engineer who will review the same and make recommendations to the city council regarding
the necessity and reasonableness of the same and otherwise regarding approval of all or part of
the costs involved. The city council shall decide whether or not it is in the public interest to allow
for reimbursement of all or any part of the proposed private construction under the city s overall
sanitary sewer and/or public water distribution plans. (Ord. 1754 § 1 (part), 1999)
